Terms of Service — Envios Digitales

These Terms of Service ("Terms") govern your use of the website enviosdigitales.com and any services, courses or workshops provided by Envios Digitales, LLC ("Envios Digitales", "we", "us"). By using the Site or enrolling in a course, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to enroll in a course. Students under 18 must have written parental or guardian consent.

2. Enrollment, fees and payment

Tuition and fees are listed on the Site at the time of enrollment.
A $50 non-binding deposit reserves your seat. Full tuition is due before the first session.
Payment plans are available for courses over $300 — three monthly installments at no extra cost.
All prices are in U.S. dollars and exclude any applicable taxes.

3. Refunds and cancellations

The $50 deposit is fully refundable up to fourteen days before a course begins.
Full tuition is refundable on a prorated basis until the end of the second session.
If Envios Digitales cancels a course for any reason, you will receive a full refund or the option to transfer to another cohort.
Field-trip courses may be rescheduled due to weather; no refund is owed for weather rescheduling, but you may transfer at no cost.

4. Studio rules and safety

While at our studio or on a field trip, students agree to follow instructor guidance, treat equipment with care, and respect other participants. We reserve the right to dismiss any student whose conduct disrupts a class or endangers others. No refund is owed in cases of dismissal for cause.

5. Loaner equipment

Students may borrow cameras, lenses and accessories at no cost for the duration of a course. Borrowers are responsible for reasonable care and must return equipment in the condition received. You agree to reimburse repair or replacement costs for damage resulting from negligence.

6. Intellectual property — student work

You retain full ownership of the photographs you create in our courses. By enrolling, you grant Envios Digitales a non-exclusive, royalty-free license to display selected student work on this Site, in our studio, and in marketing materials, with appropriate credit. You may opt out of this license at any time by emailing us.

7. Intellectual property — our content

All content on the Site — including text, images, logos, course curricula, lighting diagrams and instructional handouts — is owned by Envios Digitales, LLC or licensed to us, and is protected by U.S. and international copyright law. You may not reproduce or redistribute it without written permission.

8. Photography and model releases

Group classes may be photographed for documentary or marketing purposes. If you prefer not to be photographed, let your instructor know at the start of the first session and we will accommodate you.

9. Acceptable use of the Site

You agree not to use the Site to (a) violate any law, (b) infringe anyone's intellectual property rights, (c) transmit malicious code, (d) attempt unauthorized access to our systems, or (e) collect personal data about other visitors.

10. Disclaimers

The Site and our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee a particular career or income outcome from completing a course. Photography is a craft and individual results vary.

11. Limitation of liability

To the maximum extent allowed by law, Envios Digitales, LLC and its instructors are not liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of the Site, attendance at a class, or any field trip. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to defend, indemnify and hold harmless Envios Digitales, LLC, its owner, instructors and contractors from any claim arising out of your breach of these Terms or your misuse of the Site or services.

13. Governing law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Marion County, Indiana.

14. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page with a new "Last updated" date. Continued use of the Site after a change means you accept the updated Terms.
